Board Meeting

April 18, 2001

Present: Board members - Lynn Jones, Chuck Kilgore, & Mike Foster. Julie Lancaster from Management.

Jim MacGillivray of Ausherman Development was present to give an update on the improvements to Opossumtown Pike. - The upgrades to Opossumtown Pike by the North Crossing entrance will be the same design as the road in front of Frederick Community College. There will be sidewalks on both sides of the road. There will be trees on the outside of the road on the North Crossing side. Lights will be installed in the median from Poole Jones Road to the entrance of North Crossing. From the entrance of North Crossing to the entrance of Willowbrook lights will be installed and staggered on both sides of the road. The speed limit will be 25 mph during construction. The road will be open to traffic at all times. There may be a brief close at the entrance to North Crossing. The construction from Poole Jones Road to North Crossing is scheduled to be completed by Labor Day.

Meeting called to order at 8:07.

Approval of Minutes - Chuck motioned to approve the minutes from the March meeting. Lynn second. All in favor.

Approval of Financials -Chuck stated there are 29 homeowners that still have an outstanding balance and 17 of them have paid nothing. Check to see who still has an outstanding balance on April 30, 2001. Any homeowner who has not made arrangements to pay send a notice of intent to file lien letter. If anyone wants a payment plan it must be in writing. After 30 days file liens. A balance should show on 129 Harpers Way and a new lien needs to be filed. Chuck motioned to approve. Lynn second. All in favor.

Old Business - Lynn will speak to Rev Price of the Church of God to have him write a statement for the next newsletter.

Chuck and Lynn met to review the reserve study proposals. Chuck called and checked references and stated he believes Reserve Advisors is the company to use. They have done many studies in the Frederick area and also have done studies on communities with townhouses and single-family homes. They also have worked in communities that are not built out yet. They are a national company. Their prices were competitive. They are charging $3,600.00 and we budgeted $5,000.00 for this. A retainer check for $1,600.00 is required. There was an option to have another study in two years for a savings of $500.00 but Chuck doesn’t feel the community should obligate itself at this time. Once the study is completed we should make copies available to any homeowner who wishes to have a copy. Chuck motioned to sign with Reserve Advisors, send a check for $1,600.00, no additional copies and no option to return in 2 - 3 years. Mike Foster second. All in favor. The association should probably put the recommended funds in a separate account.

Lynn thanked Gene Fitzgibbons for purchasing and planting the trees that needed to be replaced in the community. If we need to water there are soaker hoses available.

There is a problem with dog feces not being picked up at one of the townhouses. Julie reviewed and presented pictures taken. Julie stated she did not believe the amount of feces would warrant a fine from the health department. This property will be reviewed during the walk through this Saturday, April 21st.

New Business - There was a discussion regarding the web page and if it was feasible to continue. Angie should remind homeowners of the option to advertise any business on the web page in the newsletter. Also Mike Foster will include future newsletters on the web page. Also once the meeting minutes are approved they also will be posted.

Committee Reports - Social Committee - The Easter Egg Hunt was very successful with a lot of homeowners attending. The yard sale will be the next community event the social committee is working on.

Architectural - The walk through is scheduled for Saturday, April 21st and may not be completed in one day. There has been a privacy fence installed at 197 Midsummer Drive. Ausherman previously installed and approved a privacy fence, for screening, between this property and the Crum property and now the homeowners have added to that fence. A letter needs to be sent to the homeowners.

Pool - Chuck stated no one showed up at the meeting. Chuck presented a draft copy of the pool rules, which are the same as last year. There will be two sessions for taking pictures for pool passes (May 10th and May 12th). This needs to be mailed to all homeowners no later than May 1st. One change is the hours of the pool will be 10:00 a.m. to 6:00 p.m. on Tuesdays and Thursdays. This was proposed in the last newsletter and there was no feedback regarding this. We could get a price from Century to extend the hours but the price will probably be high. The prices are based on paying the lifeguards for so many hours. This does not have to be set in stone and could be changed if it seems to be a problem in the future. Chuck motioned to change the hours as mentioned for Tuesday and Thursday. Lynn second. All in favor. Chuck motioned for the board to reaffirm the pool rules from last year. Mike Foster second. All in favor. Be sure Daydream still has a key to cut the grass in the pool area. There will be a pool inspection on April 25th. Chuck reviewed the proposal from Century for work that is needed to open the pool and stated to pay $975.94. Chuck is still reviewing placing a vending machine by the pool. Last year swim lessons were not offered but will be offered this year. The information will be in the newsletter. There will be no pool open house this year due to the fact that no one showed up last year. If the pool has to close due to rain we can bank those hours to use later. Century should contact Julie if there is a question regarding closing the pool.

Open Forum - John Pressel asked about the reserve study and Chuck gave him an update regarding this.
